LUCY MYLREA QUAYLE TO Edward John Dickson

Marriage Contract - 1858 (Castletown)

This indenture made the fifth day of October one thousand eight hundred and fifty eight between Edward John Dickson of Castletown in the Isle of Man esquire, captain commanding detachments and prisoners in the said Isle of the first part, and Lucy Mylrea Quayle of Castletown aforesaid, spinster, daughter of the late John Quayle of Castletown aforesaid, esquire of the second part, and Robert Thomas Quayle and Patrick Taubman Cunninghame esquire of Castletown of the third part

Whereas a marriage is intended shortly to be had and solmnised between the said Edward John Dickson and Lucy Mylrea Quayle

And whereas the said Lucy Mylrea Quayle is entitled to the sum of two thousand pounds (but not payable to her until the decease or second marriage of her mother Margaret Frissel Quayle, widow, under a certain indenture or Deed of Settlement of the property of the said John Quayle deceased dated the eleventh day of June 1857 by which Deed the said John Quayle and Margaret Frissel his wife granted and conveyed their real estate in the parishes of Andreas, Lezayre, Maughold, Ballaugh, Conchan, Malew, Rushen, Santon and German and the personal estate of the said JOhn Quayle to John Frissel Crellin, Frederick ... Clucas, and James Gell esquire in trust for the purposes in the said Deed mentioned and which Deed was on the 16th day of October passed as the will of the said John Quayle

ANd whereas upon the treaty of the said intended marriage it was argued that the said sum of two thousand pounds and any other property to which the said Lucy Mylrea Quayle may become entitled in her own right during her intended coverture should be settled upon the Trusts and for the purposes hereinafter ........... of and concerning the same

Now this Indenture witnesseth that in .... of the said intended marriage and of the sum of five shillings to the said Lucy Mylrea Quayle paid by Robert Thomas Quayle and Patrick Taubman Cunninghame the receipt whereof is hereby acknowledged, she the said Lucy Mylrea Quayle with the ... of the said Edward John DIckson hath bargained, sold, transferred and assifned and by these presents doth bargain, sell, transfer and assign unto the said Robert Thomas Quayle and Patrick Cunninghame all the said sum of two thousand pounds to which Lucy Mylrea Quayle is entitled as aforesaid under the said Deed of the 11th day of June 1857

To have and to hold the same, and all the right, title and interest of the said Luly Mylrea Quayle therein both in law and in equity unto the said Robert Thomas Quayle and Patrick Taubman Cunninghame and the surviving ... and the executors, administrators and assigns of the survivor in trust for the purposes hereinafter mentioned

And further in consideration of the said intended marriage he the said Edward John Dickson for himself, his executors and administrators hereby covenants and agrees with the said Robert Thomas Quayle and Patrick Taubman Cunninghame and the survivor of them and the executors, administrators and assigns of such survivor, that all real and personal estate to which the said Edward John Dickson and Lucy Mylrea Quayle or either of them in right of the said Lucy Mylrea Quayle shall at any time or times .... the said intended coverture become seized or possessed or to which they or either of them in ... right shall become entitled either at law or in equity under any gift by Deed ..Grant or any device or bequest in her favour or by descent or representation shall be assured and executed and that the said Edward John Dickson and Lucy Mylrea Quayle and either of them shall do and execute and concur in doing and executing all such acts and deeds as may be necessary or required for assuring and settling every part and parcel thereof unto and upon the trustees under these presents and upon the trusts hereinafter mentioned

And further that the said Edward John Dickson and Lucy Mylrea Quayle and either of them shall make or execute any other or further Deed or Deeds which may be necessary for the better assuring unto the said Robert Thomas Quayle and Patrick Taubman Cunninghame and the survivor of them and the executor, administrator and assign of such survivoror other the trustee or trustees for the time being under these presents the premises hereby required or intended so to be all which acts and deeds shall be all .................... of the said Edward John Dickson and Lucy Mylrea Quayle and shall be charged on the annual income to arise from the said premises and in order, the better to enable the trustee or trustees for the time being under these presents to get in the premises, this Indenture further ............ that the said Edward John Dickson and Lucy Mylrea Quayle and each of them do and doth irrevocably appoint the trustee or trustees for the time being their and each of their attorney or attorneys for each of them the said Edward John Dickson and Lucy Mylrea Quayle and in their names or the name of either of them to act, demand, sue for, recover or receive hereby assigned and settled as hereinbefore mentioned .. trust until the solmnisation of the said intended marriage for the use of the said Lucy Mylrea Quayle her executors, administrators or assigns and from the solmnisation of such marriage upon trust to .... the personal estate assigned or intended to be assured as aforesaid from time to time in the purchase of said real estate or on such real security in the Isle of Man or elsewhere or in the purchase of such government .......... or ............... or of such debentures, bonds or mortgaes of public bodies or companies authorised by Act of Parliament or Act of Tynwald to borrow money as may be consented to and directed in writing by the said Edward John Dickson and Lucy Mylrea Quayle and by and with such consent and direction as aforesaid to alter and transfer the securities from time to time and in trust from time to time to pay the interest, income, rents, and dividends which shall arise from the trust property ............real and personal to the said Lucy Mylrea Quayle during the lifetime of the said Edward John Dickson for the sole and separate use of her the said Lucy Mylrea Quayle independently and exclusively of the said Edward John Dickson and .... the same being in any wise subject to his control, debts, contracts, liabilities, or engagements and the receipt of the said Lucy Mylrea Quayle notwithstanding her coverture shall from time to time be a sufficient discharge to the trustees or trustee under these presents

Provided always that the said Lucy Mylrea Quayle shall not have power to encumber or anticipate the said interest, rents, dividends and income or any part thereof

And upon the decease of the said Lucy Mylrea Quayle, in the lifetime of the said Edward John Dickson in trust to make over, secure, and convey the trust property to and amongst the issue of the said intermarriage or such of them or to and for the benefit of such issue or some of such issue in such manner and subject to such trusts as may be declared and appointed by the said Edward John Dickson and Lucy Mylrea Quayle in any Deed or instrument in writing to be by these jointly executed and in default of any such joint appointment then in trust to make over, reserve and convey the trust property to and amongst or for the benefit of the issue of the said intended marriage or such of them in such manner and subject to such trusts as may be declared and appointed in any Deed or instrument in writing which may executed by the said Lucy Mylrea Quayle as in her last will and testament notwithstanding her coverture

And in default of any such appointment then in trust to divide and pay over to the children of the said intended marriage equally between them, the said trust property, the issue of any deceased child to be entitled equally between them to the .. to which their parent could be entitled to if living

Provided always that in case any of the issue of the said intended marriagebe minors then the shares of such minors in the said trust shall be assigned and ......... to the said Edward John Dickson and such other person as may be nominated by him and the trustee or trustees under these presents for the time being in trust for the said minors respectively but the income of the said minors' shares during the minority of the said minors respectively to be paid to the said Edward John Dickson to be by him applied in such manner as he may judge best and expedient for the benefit of the minor or minors in respect of .... share the income is derived, the Deed of assigning the shares of such minors to contain all such statutes and premises as the trustees and trustee for the time being under these presents may deem necessary for the investment of such shares and the appointment of future trustees and the indemnity of such trustees

And in case there be no issue from the intended marriage then the trust to convey so much of the trust property as may be real estate to the heir at law the said Lucy Mylrea Quayle and so much of the trust property as may be personal estate to the to the next of kin of Lucy Mylrea Quayle. And in case the said Lucy Mylrea Quayle shall survive Edward John Dickson then upon his decease then the trust to convey, assure and make over the whole of the trust property to the said Lucy Mylrea Quayle for her absolute property

Provided always that it shall be lawful for the trustees or trustee hereunder and they and he are hereby empowered from time to time to let any real estate part of the trust property for such term of years not exceeding twenty one years as such trustees or trustee may judge necessary the lease to be given for a fair yearly rent to be reserved out of the premises

Provided also that it shall be lawful for the said trustees or trustee hereunder for the time being with the consent and by the direction in writing of the said Edward John Dickson and Lucy Mylrea Quayle to sell any part of the real estate of which may be part of the trust property or to exchange the same for other real estate and to lay out the ..... of the sale of any part of such real estate in the purchase of other real estate in the manner hereinafter directed ....... to the investment of the trust property

And it is hereby declared that the real estate to be purchased is received as exchanged aforesaid shall be held by the said trustees or trustee on the like rents and subject to prior to this sale exchange thereof

Provided also that with the like current said direction any part of the real estate part of the trust property may be sold on ground rent or surity on ground rent and in such case, such ground rent shall be deemed part of the income of the trust property and applied accordingly

Provided also and it is hereby declared that if the said trustees or either of them or any future trustee or trustees under these presents shall die or be desirous of resigning or being discharged of and from, is refused or declined to sit on the Executive of the trust hereby created before the said trust shall be fully performed then, and in such case, and when and so often as the same shall happen, it shall and may be lawful to and for the said John Edward Dickson and Lucy Mylrea Quayle by writing under their hands to nominate and appoint any other person or persons to be a trustee or trustees in the place of the trustee or trustees so dying, desiring to be discharged, refusing, declinng or becoming incapacitated to act as prescribed and .... all and singular the trust property shall be conveyed unto and be vested in the new trustee or trustees either jointly with the surviving or continuing trustee or in such new trustee or trustees only as ... shall require to for, and upon such and the same trustees intent and purposes as are hereinbefore expressed and declared of and concerning the same

Provided also that the trustees or trustee for the time being under these presents shall not be answerable for the acts or defaults of each others ...withstanding that they may have joinged in deeds or receipts in the ... of conformity nor for the failure of any banker or broker with whom or in whose hands any of the trust monies may be deposited or shall be nor for any unavoidable loss nor in respect of any act in .......... of these presents done with the consent and direction of the said Edward John Dickson and Lucy Mylrea Quayle, nor for anything ............. may actually come into the hands of such trustees or trustee and for their or his own wilful default

Provided also that the said trustees or trustee shall have the power to reimburse themselves and himself out of the trust property and income for all charges and expenses incurred in the management of the trust property and in the execution of the trusts hereof and for there trouble with reference thereto

Witnesses whereof the parties hereto have hereunto subscribed their names the day and month and year first before written

NOTES

  1. Lucy was descended from the Mylrea clan of Deemsters/Archdeacons/MHKs/Attorneies General; also once possessors of the Dollough estate
  2. Her grantparents were John Quayle and Lucy Mylrea, and her parents were John Quayle jnr and Margaret Frissel Tellet. Their daughter Lucy Mylrea Quayle was their sixth child, born in 1837
  3. The Quayles too were a family of influence
  4. Lucy Mylrea Quayle was 21 when she married Edward John Dickson. He was a widower, an army officer, and about 15 years older than Lucy
  5. The trustees of this Indenture are her brother Robert Thomas Quayle and her brother in law Patrick Taubman Cunninghame. Robert Thomas was also a trustee in the Marriage Contract for her sister Margaret Frissell Quayle with Patrick Taubman Cunninghame 5 years earlier
  6. The will of her mother Margaret Frissell Quayle als Tellet is further evidence of the continuing wealth in the Quayle family, some of which would have come from the Tellett family
  7. Of the nine children in the Quayle family, only Lucy had (14) children and brother George had (3) children
  8. Captain Edward John Dickson was by 1881, Major General Dickson
  9. Of those 14 children, none of the girls married, only one son remained on the island, one went to Canada and another to South Africa, while the others found adult lives in the UK
  10. Edward John Dickson died in 1902 and Lucy in 1915
