JOHN MYLROIE to ROBERT KELLY

Mortgage - 1853 (Lonan)

Know all men by these presents that I John Mylroie of Ballacosney in the parish of Lonan doth own and acknowledge himself to be and stand justly endebted unto Robert Kelly jnr of Laxey Glen in the said (parish) of Lonan in the full and just sum of fifty pounds British to the payment whereof well and truly to be made to the said Robert Kelly, his heirs, executors, administrators and assigns with interest thereunto at and after the rate of six per cent per annum and all costs and charges attending the same upon either party receiving one month’s previous notice from the other the said John Mylroie doth bind and oblige himself, and his heirs, executors, administrators and assigns in and under the penalty herein after mentioned and for the further and better security of the said Robert Kelly, his heirs, executors, administrators and assigns in the premises further know ye that he the said John Mylroie by and with the consent of Elinor Mylroie (otherwise Fargher) testified by her becoming an executing party hereunto hath give, granted and passed over in security unto the said Robert Kelly, his heirs, executors, administrators and assigns all and singular that two fields viz. the meadow and the bottom of Neay Vooar below the road that leads from Laxey to the mountain being bounded on the east by the rent of John Croughan, on the south John Kewley’s rent, on the west by the rent John Hutchin and James Kewley, and on the north east by the said road that leads from Laxey to the mountain and comprising the whole of the said John Mylroie’s property below the said road to have and to hold the said lands and premises (being part of the estate of Ballacosney) with ways, waters, watercourses, easements, liberties, rights, members and appurtenances thereunto belonging or in any wise appertaining unto the said Robert Kelly, his heirs, executors, administrators and assigns in security until payment of the said principal sum of fifty pounds British with interest there… and all costs and charges attending the same and for the true and faithful performance hereof the said John Mylroie doth bind and oblige himself, and his heirs, executors, administrators and assigns in and under the penalty of one hundred pounds British to be levied and paid according to law. Know all men by these presents that I Robert Kelly of the parish of Lonan do hereby fully acknowledge to have received from the hands of John Mylroie of the parish of Lonan the sum of fifty pounds sterling being the amount of a Bond and Security affecting and chargeable upon the lands and premises the meadow and the bottom of the Naih Voar being part of the Quarterland of Ballacosney in the parish of Lonan, the said Bond and Security bearing date the 5th day of May 1853 the principal sum of fifty pounds with the interest, costs and charges attending the same I Robert Kelly hath fully received and do by virtue of these presents bequest and exonerate the said John Mylroie from any further claim or demand in regard to the said Bond and do request that the same will stand cancelled on record forever.   2. John Mylroie was the oldest son of James Mylroie jnr & Ann Kewley
  3. He was baptised 1826, and married Elleanor Fargher in Lonan in 1852
  4. There were 7 children: John James 1853, William Henry 1854, Thomas Arthur 1855, Frederick 1858, Edward George 1861-1861, Richard Fargher 1864-1884 & Elleanor Ann 1865
  5. John's grandfather, James snr, had settled the family's Ballacosney estate onto James jnr in 1828 and James jnr settled the estate onto John in 1853, a year after his marriage to Elleanor Fargher
  6. In 1853, John took a mortgage for £50 from Robert Kelly, who mght have been his uncle as his father's sister, Eleanor, had married a Robert Kelly. The debt was repaid in 1861
  7. In 1858 John took a mortgage for £300 from William Fargher, and enormous sum for the day and Ballacosney was put up as security
  8. This 1865 mortgage looks like an update of the 1858 mortgage, for the amount involved is £364/17/-
  9. In 1876 John died just two years after his father, leaving his son twenty-three year old son, John James, as heir at law
  10. John's grandson John Isaac Mylroie (the only son of John James, eventually sold the estate in 1908 perhaps because the debt had grown substantially by that time, and Ballacosney was gone from the Mylroie family forever
