DANIEL McYLREA with WILLIAM KILLIP, PHILIP KILLIP & JON COWLEY

SETTLEMENT - 1709 (Ballaugh)

Whereas we William Killip, Philip Killip and Jon Cowley owners of Scrandal Miln in the parish of Ballaugh having a right to all the farmers of the said parish as tenants to our aforesaid Miln amongst whom Daniel McYlrea Deemster is tenant as well as the rest.

Be it known therefore that we the aforesaid owners of the said Miln do by these presents for several considerations and more especially for and in consideration of the sum of twenty shillings sterling already had and received (the receipt thereof being hereby acknowledged from and at the hands of the said Daniel McYlrea) acquit, discharge and forever free him his heirs, executors, administrators and assigns from being tenants or from grinding any of his or their corn of what kind or nature forever in or at the said Miln but that the said Daniel McYlrea and his heirs are at liberty forever hereafter to grind his or their corn of all sorts (be their quantity great or small) where and at what Miln they please. To these presents we oblige ourselves and if necessary to procure the worshipful officer’s confirmation and do all other things needful for the assurance hereof and hereunto we bind ourselves our heirs, executors, administrators and assigns in the penalty and forfeiture of fifty pounds sterling in the nature of all forfeitures. Be it therefore known that we William Killip, Philip Killip and Jon Cowley owners of Scrandal Miln ... said do by these presents own and acknowledge ourselves to be fully paid and satisfied in and for the within mentioned sum of twenty shillings consideration money and do hereby acquit and discharge him the said Daniel McYlrea Deemster his heirs, executors, administrators and assigns forever from the payment of said twenty shillings or any part thereof. At a Sheading Court holden at Peel the 17th May 1709, the above Will Killip came into Court and acknowledged the above Bargain and Agreement and the within receipt to be his act and deed and the above Will Corlett and Jon Corlet the witnesses to the said Bargain and receipt have made oath in Court that the same was agreed unto and signed by the above named Phil Killip and Jon Cowley therefore the same is allowed of and confirmed according to law.
